​Insured Individuals - IRB claimants - Legal Representatives - Law Firms
  • If as a result of a motor-vehicle accident (MVA), you are unable to return to your pre-accident occupation at full capacity and perform all necessary essential tasks, you may be eligible for Income Replacement Benefit (IRB).
  • IRB is a weekly benefit paid by Insurer
  • The amount of the benefit is calculated according to Section 7 of Ontario Regulation 34/10 Statutory Accident Benefits Schedule (SABS)
  • IRB weekly entitlement may be up to 70% of lost gross income during the first 104 weeks after the accident up to a certain maximum (most often, the maximum is $400 per week) 
  • IRB amount is determined per SABS. The calculation can be complex and involves thorough accounting review of relevant documentation and records by a CPA.
  • IRB entitlement amount is determined on a case-by-case basis. Some of determining factors include:
    • Details of employment, self-employment, unemployment, or student status as of the date of MVA and prior to MVA
    • Gross weekly employment income before and after MVA
    • IRB maximum 
    • Age-based calculation
  • IRB report must be prepared by a licensed member of an accounting organization that meets the requirements and standards of the Public Accounting Act, 2004, such as Ontario CPA.
